Circular 37 of 2009 by the Council for Medical Schemes states that there is industry wide non-compliance with the provisions of the Medical Schemes Act and Regulations as far as the payment of PMBs is concerned. In this regard, BHF urges its members to take cognizance of the legal opinion that was circulated under cover of Member Communiqué MC09-41 of 30 July 2009.

BHF presented the Minister of Health with a copy of its opinion when some of the BHF directors and senior management met with him in the latter quarter of 2009 and raised the concerns regarding the interpretation of regulation 8 at this meeting. BHF is now arranging a follow-up meeting with the Minister and the acting Registrar of Medical Schemes in order to pursue the matter further.
