The judgement regarding the validity of Regulations Relating to the Obtainment of Information and the Process of Determination and Publication of Reference Price List was released Wednesday, 28th July 2010.
In essence, the judgement states that the processes followed before the promulgation of the Regulations Relating to the Obtainment of Information and the Process of Determination and Publication of Reference Price List, promulgated on 23rd July 2007 were flawed and as a result, the Regulations have been declared invalid and have been set aside . Consequentially, all acts on the part of the DG of Health, in terms of these Regulations, including the promulgation of guidelines and methodologies, notices and invitations, and the publication of any one or more national reference price list, are declared invalid and null and void, retrospectively.
